Terms of Service

1. Introduction and acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the services provided by Nordic Rooster Trading AS, a company registered in Norway, with its business address at Nordic Rooster Trading AS, Dronningens gate 22, 0154 Oslo, Norway ("we", "us", or "our").
By contacting us, requesting a quotation, placing an order, entering into a service agreement, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
These Terms apply to all customers, including private individuals and business customers, unless otherwise agreed in writing by Nordic Rooster Trading AS.
2. Scope of services
Nordic Rooster Trading AS provides the following services, subject to availability, legal restrictions, animal welfare requirements, and any specific agreement between the parties:
- Premium breeding cock supply
- Farm flock consultation
- Poultry health and care guidance
- Custom order sourcing for rare breeds
- Transport coordination within Norway
- Seasonal breeding program support
We may refuse, suspend, or limit any service request where necessary to comply with applicable law, animal welfare standards, transport requirements, biosecurity measures, or our internal policies.
Any descriptions of services, availability, breeding characteristics, health status, lineage, or transport arrangements are provided in good faith but do not constitute an absolute guarantee unless expressly confirmed in writing by Nordic Rooster Trading AS.
All services involving live animals are subject to applicable Norwegian animal welfare, veterinary, transport, and biosecurity rules. Customers are responsible for ensuring that their intended use, facilities, and handling practices comply with all relevant legal requirements.
3. User obligations and responsibilities
When using our services, you agree to:
- Provide accurate, complete, and up-to-date information at all times.
- Ensure that your premises, equipment, and care practices are suitable for the safe and lawful keeping of poultry.
- Comply with all applicable laws, regulations, permits, and reporting obligations relating to animal ownership, transport, breeding, and welfare.
- Handle all animals responsibly, humanely, and in accordance with good husbandry practices.
- Arrange appropriate veterinary care, quarantine, and biosecurity measures where necessary.
- Not use our services for unlawful, abusive, negligent, or cruel purposes.
- Promptly notify us of any material issue affecting an order, delivery, animal welfare concern, or service outcome.
You acknowledge that live animals are inherently subject to biological variation, stress, illness, injury, and other risks beyond our complete control. You are responsible for the care, supervision, and management of any animal after transfer of possession, unless otherwise expressly agreed in writing.
You must not resell, transfer, or export any animal supplied through our services in violation of applicable law or any contractual restriction expressly communicated by Nordic Rooster Trading AS.
4. Payment terms and conditions
Prices for our services will be communicated in writing, by email, quotation, invoice, or other agreed method. Unless otherwise stated, all prices are in Norwegian kroner (NOK) and may be subject to applicable taxes, fees, and charges.
Unless otherwise agreed in writing:
- Payment is due in advance or upon invoice, as specified in the relevant order confirmation.
- We may require a deposit before sourcing, reserving, or preparing any live animal or custom order.
- Any transport, veterinary, handling, quarantine, or special sourcing costs may be charged separately.
- Late payments may incur statutory default interest and reasonable collection costs in accordance with Norwegian law.
We reserve the right to suspend performance, withhold delivery, or cancel an order if payment is not received when due.
Where a quotation is provided, it remains valid only for the period stated in the quotation, or if no period is stated, for a reasonable time considering market conditions and availability.
5. Cancellation and refund policy
Cancellations must be made in writing to Nordic Rooster Trading AS at the contact details stated below.
Because our services may involve sourcing, reservation, handling, and transport of live animals, cancellation rights and refunds depend on the stage of performance and any non-recoverable costs already incurred.
- If you cancel before we have incurred any material costs, we may refund amounts paid, less any administrative fees where permitted.
- If sourcing, reservation, transport coordination, veterinary checks, or other preparatory work has already begun, we may retain amounts covering our reasonable costs and committed expenses.
- Custom orders for rare breeds or specially sourced animals may be non-cancellable or non-refundable once sourcing has commenced, except where mandatory law provides otherwise.
- No refund will be due for services already performed, advice already given, or costs already incurred in good faith on your behalf, unless required by mandatory law or expressly agreed in writing.
If an animal cannot be supplied due to circumstances within our control, we will, at our discretion and subject to applicable law, either offer a replacement, reschedule the order, or refund the relevant amount paid for the undelivered portion.
Any statutory consumer rights under Norwegian law remain unaffected where applicable.
6. Liability limitations
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful, including liability for gross negligence, intentional misconduct, or mandatory statutory liability.
Subject to the foregoing, Nordic Rooster Trading AS shall not be liable for:
- Indirect, incidental, special, or consequential losses;
- Loss of profit, revenue, goodwill, business opportunity, or expected breeding outcomes;
- Losses arising from inaccurate information provided by you;
- Losses caused by improper housing, feeding, handling, transport, or care after transfer;
- Illness, injury, stress, infertility, reduced performance, or death of animals caused by factors outside our reasonable control;
- Delays or failures caused by third-party transport providers, veterinarians, suppliers, or authorities.
To the extent permitted by law, our total aggregate liability arising out of or in connection with any service, order, or event shall be limited to the amount paid by you for the specific service giving rise to the claim, or NOK 10,000, whichever is lower, unless mandatory law requires otherwise.
Any advice or guidance provided by us is general in nature and does not replace professional veterinary diagnosis, treatment, or legal advice. You remain responsible for obtaining appropriate professional assistance where needed.
7. Intellectual property rights
All content, materials, documents, text, images, logos, service descriptions, templates, and other intellectual property made available by Nordic Rooster Trading AS remain our property or the property of our licensors, unless otherwise agreed in writing.
You are granted a limited, non-exclusive, non-transferable, revocable right to use our materials solely for the purpose of receiving and using our services.
You must not copy, reproduce, modify, distribute, publish, or commercially exploit our materials without our prior written consent, except where such use is permitted by mandatory law.
Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation, unless otherwise agreed in writing.
8. Data protection and privacy
Nordic Rooster Trading AS processes personal data in accordance with applicable Norwegian data protection law and the General Data Protection Regulation (GDPR), where applicable.
We collect and process personal data only to the extent necessary for purposes such as:
- Managing enquiries, quotations, and orders;
- Providing services and coordinating transport;
- Communicating with customers and suppliers;
- Maintaining accounting, tax, and legal records;
- Complying with legal obligations and animal welfare requirements.
We may share personal data with trusted third parties where necessary to perform our services, such as transport providers, veterinarians, accountants, IT service providers, or public authorities, subject to applicable law and appropriate safeguards.

9. Force majeure
We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to:
- Extreme weather, natural disasters, fire, flood, or epidemic;
- Government action, legal restrictions, border controls, or transport bans;
- War, terrorism, civil unrest, strikes, or labour disputes;
- Power failures, telecommunications outages, or system disruptions;
- Unavailability of animals, suppliers, transport, or veterinary services due to external causes.
If a force majeure event continues for a prolonged period, either party may be entitled to suspend or terminate the affected service arrangement to the extent permitted by law.
10. Changes to terms
Nordic Rooster Trading AS may update or amend these Terms from time to time to reflect changes in our services, legal requirements, or operational needs.
The updated Terms will take effect upon publication or on a later date specified by us. Where required by law or where the changes are material, we will provide reasonable notice.
Your continued use of our services after the effective date of any updated Terms constitutes acceptance of the revised Terms.
11. Applicable law and jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of Norway.
Any dispute arising out of or relating to these Terms, our services, or any related agreement shall be subject to the exclusive jurisdiction of the competent courts of Norway, unless mandatory consumer protection rules provide otherwise.
If you are a consumer, you may have rights under mandatory Norwegian consumer law and any applicable dispute resolution mechanisms.

13. Severability clause
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a competent court or authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, it shall be severed from these Terms.
The remaining provisions shall continue in full force and effect.
